1. Service Description

Artifex AI ("[COMPANY NAME]", "we", "us", or "our") provides an AI-powered headshot generation platform that allows users to upload reference photos and generate professional-quality AI headshots for various contexts including professional, leisure, and dating profiles.

2. User Obligations

By using our service, you agree to:

  • Provide accurate and truthful information during registration
  • Upload only photos of yourself or photos you have explicit permission to use
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable laws and regulations
  • Not use the service for fraudulent, deceptive, or illegal purposes

3. Acceptable Use

You may not use the generated headshots to:

  • Impersonate another person or create misleading identities
  • Engage in harassment, defamation, or any unlawful activity
  • Create content that violates the rights of any third party
  • Circumvent or attempt to circumvent any security measures of the platform

4. Intellectual Property Rights

Upon generation and payment, you receive a non-exclusive, worldwide, royalty-free license to use your generated headshots for personal and commercial purposes. You retain all rights to your uploaded reference photos. We retain the right to use anonymized, aggregated data to improve our AI models.

5. Limitation of Liability

To the maximum extent permitted by law, [COMPANY NAME] shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

6. Biometric Data Handling

Our service processes facial photographs for AI headshot generation. This may constitute biometric data processing under certain jurisdictions. By using our service, you explicitly consent to this processing. Your biometric data is:

  • Used solely for the purpose of generating AI headshots
  • Encrypted at rest and in transit
  • Deleted within 30 days of your request or account deletion
  • Not sold or shared with third parties for unrelated purposes

7. Pricing and Packages

Our service operates on a headshot-based model. You purchase a headshot package in advance and each generation draws directly from your headshot allowance. All payments are processed securely through Stripe.

  • Headshot packages are available in Starter (40 headshots), Popular (80 headshots), and Pro (150 headshots) tiers
  • Starter packages include a single photo context; Popular and Pro packages include access to all photo contexts
  • Pro packages generate headshots at 2048 px resolution; Starter and Popular packages generate at 1024 px resolution
  • Unused headshot allowances do not expire
  • Headshot allowances are non-transferable between accounts

8. Satisfaction Guarantee and Refund Policy

We stand behind the quality of our AI headshots with a 7-day satisfaction guarantee — what we call our "Profile-Worthy Promise."

Eligibility

  • Refund requests must be submitted within 7 calendar days of your purchase date
  • Only one refund request is permitted per purchase transaction
  • You may only request a refund for a package you have not already received a refund for

First Refund — Automatic Processing

If this is your first refund request with Artifex AI, it will be processed automatically:

  • Your Stripe payment will be refunded in full to your original payment method
  • Your headshot allowance will be adjusted to reflect the refunded package
  • Generated headshots associated with the refunded package will be deleted from our servers within 48 hours
  • Refunds typically appear on your statement within 5–10 business days, depending on your bank

Subsequent Refund Requests — Manual Review

Refund requests beyond your first will be subject to manual review by our support team. We will respond within 2 business days. Approval is at our discretion and may be declined if we determine the guarantee is being abused.

Non-Refundable Situations

  • Refund requests submitted more than 7 days after purchase
  • Headshots consumed during a generation run that completed successfully
  • Accounts suspended for terms of service violations

To request a refund, visit your account dashboard and click "Request Refund" next to your eligible purchase.

9. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may terminate your account at any time by contacting us. Upon termination:

  • Your uploaded photos and generated headshots will be permanently deleted
  • Unused headshot allowances will be forfeited unless a refund is approved under our satisfaction guarantee
  • Your personal data will be handled in accordance with our Privacy Policy and GDPR requirements
